Welcome to Samagra! These Terms of Service (“Terms”) govern your access to and use of the Samagra website and mobile application (collectively, the “Service”). By using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. About Samagra

Samagra is an online platform that empowers individuals and small businesses from the lower and lower-middle class to sell a variety of daily-use items. Our mission is to create a digital marketplace that connects sellers of high-quality, authentic products with a wider customer base. The products available on our platform include:

  • Eatables & Festive Snacks: Dry snacks, chivda, chikki, laddoo, and festive combos.
  • Groceries & Essentials: Various types of rice, flour (wheat, jowar, bajra, ragi), pulses, spices, oils, and ghee.
  • Jewellery & Accessories: Traditional imitation, oxidized silver, temple, and antique gold-plated jewelry.
  • Clothing & Apparels: A range of women’s, men’s, and kids’ clothing, as well as quilts and blankets.
  • Homecare & Eco-friendly Products: Herbal and natural cleaning products, including cow dung and Gau Ark products.
  • Spiritual & Religious Items: Pooja articles, miniature temples, and pooja samagri.
  • Cultural & Festive Decor: Lanterns, rangoli colors, diyas, and festive wall hangings.

2. User Accounts

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, complete, and current information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify Samagra immediately of any unauthorized use of your account.

3. Seller Responsibilities

Users are strictly prohibited from placing fraudulent orders, engaging in abusive conduct, infringing third-party intellectual property, or using the platform for unlawful purposes.
If you are a seller on Samagra, you agree to the following

  • Product Quality: All products listed must be of a reasonable quality and as described in your product listings. You are responsible for the accuracy of your product descriptions, including materials, dimensions, and any other relevant details.
  • Ethical Sourcing: All products must be ethically sourced and comply with all applicable laws and regulations.
  • Pricing: You are responsible for setting the prices for your products. Samagra will deduct a commission as specified in the Seller Agreement.
  • Order Fulfillment: You are responsible for timely processing and shipping of all orders. You must communicate with customers regarding any delays or issues.
  • Prohibited Items: You may not list or sell any items that are illegal, dangerous, or otherwise prohibited by Samagra’s policies. This includes, but is not limited to, weapons, illegal drugs, and counterfeit goods.

4. Buyer Responsibilities

As a buyer on Samagra, you agree to the following:

  • Payment: You agree to pay for products and services you purchase through the platform. All payments are processed through secure payment gateways.
  • Shipping & Delivery: While Samagra facilitates the connection between buyers and sellers, sellers are responsible for shipping. Any issues with delivery should be first addressed with the seller.
  • Disputes: If you have a dispute with a seller, you should first attempt to resolve it directly with the seller. If a resolution cannot be reached, Samagra may offer a dispute resolution process.

5. Intellectual Property

  • Your Content: You retain ownership of any content you submit to the Service, including product listings, images, and reviews. By submitting content, you grant Samagra a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display the content for the purpose of operating and promoting the Service.
  • Samagra’s Content: The Service and its original content, features, and functionality are and will remain the exclusive property of Samagra and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6.Limitation of Liability

Samagra shall not, under any circumstances, be liable for indirect, incidental, consequential, exemplary, or punitive damages, even if advised of the possibility thereof. Liability, if any, shall not exceed the commission fee earned on the disputed transaction.
Samagra acts as a marketplace and is not a party to the transactions between buyers and sellers. We do not manufacture, sell, or inspect the products listed on our platform. Therefore, we are not responsible for any issues arising from the quality, safety, or legality of the products. Samagra’s liability is limited to the commission received on a transaction. In no event shall Samagra be liable for any indirect, incidental, special, consequential, or punitive damages.

7.Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may do so by contacting us.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

8.Contact Information

Dispute Resolution: All disputes shall first be attempted to be resolved through good-faith negotiations. If unresolved, they shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, seated in Mumbai, with proceedings in English. Courts at Mumbai shall have exclusive jurisdiction thereafter.
